1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the MED Umeme electricity token vending service, including our mobile application and website (collectively, the "Service"), operated by MED Umeme ("we", "our", or "us") in Tanzania.
By creating an account or using our Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them.
2. Description of Service
MED Umeme provides a platform that allows customers to purchase TANESCO/LUKU electricity tokens for both main meters and submeters using mobile money payments in Tanzania. We act as an authorised reseller/agent and process payments through ZenoPay.
Our Service includes:
- Electricity token purchase for TANESCO main meters
- Electricity token purchase for registered submeters
- Transaction history and token records
- Mobile money USSD push payment (M-Pesa, Airtel Money, Tigo Pesa, HaloPesa)
3. Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.
- One person may not maintain multiple accounts.
4. Purchases & Payments
4.1 How Payments Work
When you initiate a purchase, you authorise us to collect the full amount (electricity value + service fee) from your mobile money account via USSD push. You will receive a prompt on your phone to confirm the payment.
4.2 Service Fee
A service fee is charged on each transaction. The fee is displayed clearly before you confirm your purchase. The electricity token you receive corresponds to the amount after deducting the service fee.
4.3 Minimum & Maximum Purchase
Minimum and maximum purchase amounts are set by the system and displayed during checkout. These limits may be updated from time to time.
4.4 Payment Processing
Payments are processed by ZenoPay. By making a payment, you also agree to ZenoPay's terms and conditions. We are not responsible for delays or failures caused by mobile network operators or ZenoPay's systems.
5. Refund & Dispute Policy
Important: Electricity tokens are non-refundable once successfully issued by TANESCO/LUKU.
5.1 Successful Transactions
Once an electricity token has been successfully generated and delivered, no refund will be issued. Tokens are activated immediately upon entry into a meter and cannot be reversed.
5.2 Failed Transactions
If your payment was deducted but no token was delivered due to a system failure on our end, we will either:
- Automatically retry and deliver your token, or
- Issue a full refund to your mobile money account within 3–5 business days
5.3 Disputes
For any payment dispute, contact us within 7 days of the transaction with your transaction reference number. We will investigate and respond within 3 business days.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Tanzanian law
- Attempt to access another user's account or transaction data
- Submit false meter numbers or fraudulent payment information
- Attempt to manipulate, hack, or abuse the payment or token generation systems
- Use automated scripts or bots to make purchases
- Resell tokens purchased through this platform without our written authorisation
7. Meter Numbers & Accuracy
You are solely responsible for entering the correct meter number. We verify meter numbers against the TANESCO system before purchase where possible, but we are not liable for tokens generated for an incorrect meter number entered by you. Always double-check your meter number before confirming a purchase.
8. Service Availability
We strive to maintain 24/7 availability but do not guarantee uninterrupted service. Downtime may occur due to:
- Scheduled maintenance (we will notify users in advance where possible)
- TANESCO/LUKU system unavailability
- Mobile network operator outages
- ZenoPay system issues
We are not liable for losses arising from service unavailability due to third-party system failures.
9. Limitation of Liability
To the maximum extent permitted by Tanzanian law, MED Umeme shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of the Service
- Loss resulting from incorrect meter numbers provided by the user
- Delays in token delivery caused by TANESCO/LUKU or network operators
- Losses caused by unauthorised access to your account due to your own negligence
Our total liability to you for any claim shall not exceed the amount paid for the specific transaction giving rise to the claim.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Tanzania.
